Commercial Tenancy (Retail Shops) Agreement Act 1985

However, it is important that all parties involved in retail leasing, such as tenants, property owners and commercial property managers, are aware of these laws. 2. If, either before or after the conclusion of the retail lease, the parties to a retail lease enter into a written or oral agreement or an agreement containing a provision which, if contained in the retail lease, would be void, that provision shall be considered, for the purposes of this Act, to be contained in the retail lease and that law shall apply to that provision and, in respect of that provision, as if it were included. All of these changes do not apply to leases entered into before that date. We have created a series of commercial leasing publications to answer frequently asked questions about the law, which have been concluded specifically for lease agreements concluded before and after January 1, 2013. leasing means any rental agreement, licence or agreement, whether in writing or not, which provides for the use of premises within the State, whether for a period of time or through a periodic lease or a lease at will, and whether the rental agreement, licence or contract is concluded outside the State or purports to be subject to a law other than that of the State, but does not contain a licence or agreement on the common space of a retail shopping centre only where it provides for a person to use a part of the Community space the re-use of which as part of the Community space is not to be excluded by other means; Consumer protection administers the Commercial Tenancy (Retail Shops) Agreements Act 1985, which regulates retail leases. The law focuses mainly on the need for transparency of information and fairness in the treaty. .
